1.1. This term governs all purchases made on the HEAVEN Platform.
1.3. HEAVEN does not make prior editorial control of the commercialized products, nor does it evaluate the technicality and experience of those who produce them. The existence of a product and its acquisition through the platform cannot be considered as a guarantee of quality of content and result, under any circumstances. By acquiring it, the Buyer declares to be aware of this information.
1.4. HEAVEN may refuse or cancel a purchase order, in addition to the payment of commissions to the Affiliates, if it identifies that the Buyer is an Affiliate purchasing from its own link, or if the Buyer's data is not fully filled in with real information about him/herself.
1.5. HEAVEN may refuse to approve a purchase requested by a Buyer who has already made more than one refund request through the Platform.
1.6. Even with our commitment and effort to maintain the best practices, the services and functionalities made available through the Platform are provided as they are ("as it is" ) , with no express or implied guarantees, including, among others, guarantees of merchantability, fitness for a particular purpose, proprietary, non-infringement, and protection against computer viruses or other harmful code.
1.7. Any additional information about the Product must be obtained by the Buyer directly from the Producer after purchase. The Buyer will receive in the purchase confirmation email data to contact the Producer.
1.8. The purchase will appear on the card statement or invoice indicating the name of Pagar.me. However, this consists of a mere identification of HEAVEN as a payment facilitator, either on the invoice or card statement, and does not make the Platform a seller or responsible for the Product, nor for its functionality, characteristics, offer and advertising.
1.9. For problems and questions about the purchase, such as payment options, access to the Product in cases where the content is being delivered through the HEAVEN platform, the Buyer must contact our support through the HEAVEN website .
When delivery is not made via the HEAVEN platform, the Buyer must contact the PRODUCER support through the data contained in the purchase confirmation email (1.7). If the channels provided are not sufficient and there are further questions regarding the product, technical assistance or refund requests, a request may be opened here at this complaint link, thus providing the Buyer with a direct channel with the producer and HEAVEN will mediate. For details of refunds and claims see section 3 below.
1.11. By using the Platform as a Buyer, you are a contracting party for the intermediation services provided by HEAVEN. When Users carry out a transaction on a Product through the Platform, they enter into a contract directly with each other. HEAVEN is not and does not become a party, intervener or guarantor of any relationship between Users. HEAVEN does not act as an agent or distributor for any user, HEAVEN does not create, manufacture, control, endorse or supply any Product to Users. Producers are responsible for the content and information relating to their Products, being responsible for their existence and their characteristics, quality, functionality, quantity, offer and advertising. For the resolution of questions related specifically to the content of the Product purchased, the Purchaser must contact the Producer's team.
2.1. The deadline for delivery of access data may vary according to the means of payment, for example: (A) Credit card, up to 24 hours; (B) Online transfer, up to 8 hours. Deadlines must be counted from the payment confirmation.
2.2. Access data is delivered by HEAVEN only when the Producer has chosen to use the HEAVEN member area to make its contents available to users (HEAVEN CLUB), and access data is also sent by HEAVEN by email to buyers as deadlines described above. For delivery of content by other means and platforms, it is up to the producer to send access data to the content to the Buyer (end customer).
3.1. Term: The Buyer may request a refund of the amounts paid, the minimum terms established by law for the guarantee are between 07 and 30 days, but depend exclusively on the term established by the Producer, who is directly responsible for this information and for the requests and authorizations of refunds. The period will start from the time the purchase is made, refund requests after the deadline must be made directly to the Producer, and if authorized by him, except when the refund must be processed to guarantee the interests of HEAVEN and for compliance with the law.
3.1.1. HEAVEN may refuse a full refund of the amounts paid, even within the warranty period, in the event that the Purchaser has used all of the Product purchased, such as, for example, having attended all classes of a course, participated in an event, or having downloaded all available files, leaving HEAVEN and the Producer at a distinct disadvantage.
3.2. Method of processing: The refund will be processed through the same payment method chosen by the Buyer at the time of purchase, for legal and procedural reasons. Reimbursement is made by bank transfer within 30 (thirty) days from the request date. In cases of reimbursement by credit card, HEAVEN will request a reversal, but the conclusion of this process will depend exclusively on the card operators, without any management by HEAVEN and it may take a period of 30 to 60 days after the request. reversal.
3.2.1. If the refund does not occur within the above timeframes, the Purchaser must contact HEAVEN. If the refund is made by credit card, after the period of 90 (ninety) days, the Buyer undertakes to send copies of their invoices so that HEAVEN can address this matter to the operator and finalize the refund process. The buyer agrees that failure to send invoices prevents HEAVEN from continuing with the investigation process and completing the payment reversal process.
3.3. Complaints Channel: The Buyer can request the cancellation of his purchase independently, through the complaint link, simply by correctly informing the requested data and following the procedures and guidelines previously placed regarding legality and deadlines.
5.1. Trial Functionality : The Producer may make the Product available through the trial functionality, a non-binding period of use, by way of trial, by the Buyer which may vary from 1 (one) to 30 (thirty) days, according to the choice of the Producer. The Trial is intended to allow new buyers to try the Product. Eligibility for the Trial , its use and duration shall be determined by the Producer at its sole discretion. The producer may limit eligibility to prevent Trial abuse , provided it does so in accordance with these Terms. The Producer shall charge the Purchaser for the value of the Product at the end of the established Trial period , unless the Purchaser cancels the use of the Trial before the end of such period.
5.1.1. On Subscription Products, Producers may opt for Trial functionality in the free or test-drive model , at their sole discretion. The difference between these modalities is that the Buyer, when deciding to continue with the Product acquired in the test-drive mode , must pay for the period used, which does not occur in the free model.
6.1. Declined Purchases: The Producer can enable automatic sales retrieval for their Products. This tool allows transactions declined due to insufficient balance on the Buyer's card to be automatically transformed into monthly recurring transactions. It is a service offered to the Producer and directly related to its Product.
6.2. Updated data: The Buyer must keep the data informed at the time of purchase, including the credit card used, always valid and updated, so that recurring transactions are carried out on the due dates, until full payment of the amount due.
6.3. Blocked access: In the event of failure to authorize or approve any transaction relating to any subsequent month, for any reason, Buyer's access to the Product will be blocked until all overdue charges are duly paid.
7.1. When it comes to purchasing tickets for events registered by the Producer, which must take place under the Producer's full responsibility, without any subsidiary or joint liability of HEAVEN, the following rules and conditions will apply:
7.1.1. The refund rules for the requested amount paid in case of regret of the purchase are defined by the Producer. Therefore, to confirm the specific rules for the ticket to be purchased, check this information on the ticket sales page or contact the responsible Producer.
7.1.2. We remind you that in some cases the Producers only accept the refund request if it is carried out, by the Buyer, within a period of up to 7 (seven) days from the date of purchase (period may vary depending on whether the product guarantee is made available by the producer in compliance with current law), and provided that the return request is made at least 48 hours before the start time of the event. Therefore, stay tuned and carefully read the policies and rules of the event made available by the producer.
7.1.3. Reimbursement requests for ticket purchases for events requested on the day of the event or after check-in by the Purchaser will not be authorized.
7.1.4. If the Buyer chooses to upgrade the ticket initially purchased (that is, its exchange for a ticket with different conditions than the original ticket), the refund period will continue to be linked to the date of purchase of the initially purchased ticket, and the period will not change in upgrade reason.
7.1.5. The Producer organizing the event will be solely responsible for the costs and responsibilities of reimbursing all Buyers if, for whatever reason, the event does not take place or does not go as offered. HEAVEN will have the right to claim against the Producer for any amounts that the Platform is obliged to pay to Buyers due to action, claim or administrative, judicial or extrajudicial process.
7.2. It should be noted that, in the case of event tickets, taxes will be applicable in accordance with the rules and regulations of the country where the event is held.
8.1. Automatic renewal: As a rule, the renewal of a subscription occurs automatically, for the same period of time, and always at the end of the period previously defined by the Producer. In order to avoid renewal and new charges, the Buyer must cancel it before the renewal period, which can be done at any time, without any interference from HEAVEN. By not canceling a recurring charge, Buyer agrees and authorizes its renewal.
8.2. Cancellation: the Buyer can cancel a subscription as follows: through the Producer, by contacting him directly. Producer contacts are sent at the time of purchase through confirmation emails;
8.2.1. The cancellation of a subscription only prevents its renewal at the end of the period defined by the Producer, and does not suspend the collection of amounts for the period prior to the cancellation. Canceling a subscription and requesting a refund are separate procedures. In the case of reimbursement, the amounts refer to the last paid recurrence, and not to the purchase price.
